For the Dongria Kondh it is sacred ground, the home of their deity Niyam Raja, and the base of everyday life. So any push for mining or large &#8220;development&#8221; activity there becomes more than an economic debate. It becomes a question of rights, identity and survival.<\/p>\n<p><em>Source: Vikalp Sangam (13 October 2023) triggered this note. The note reflects the October 2023 position unless it gives a later date.<\/em><\/p>\n<h2>Niyamgiri is sacred and also practical life-support<\/h2>\n<p>For the Dongria Kondh, forests are food, water, medicine and dignity. Their relationship with Niyamgiri is spiritual and deeply practical at once. When forests are diverted, the community does not only lose trees. It loses a life-system of streams, hill ecology, forest produce and cultural continuity.<\/p>\n<h2>Why Niyamgiri became a national issue<\/h2>\n<p>The Dongria Kondh are known for resisting Vedanta&#8217;s bauxite mining plans. That episode turned Niyamgiri into a symbol of a larger Indian question. Can a Scheduled Area community protect its sacred ecology when powerful industrial interests arrive?<\/p>\n<p>The legal anchor is the Supreme Court judgment of 18 April 2013 in Orissa Mining Corporation v. Ministry of Environment and Forests. The Court held that gram sabhas have a role in protecting the religious and cultural rights of Scheduled Tribes under the Forest Rights Act, 2006. It asked the Dongria Kondh villages to decide. Press reports say the village councils (palli sabhas) rejected mining, and the environment ministry did not clear the project.<\/p>\n<h2>What triggered new anxiety<\/h2>\n<p>The 2023 concern was about forest governance. Many critics worried about the Forest Conservation Rules, 2022 and the Forest (Conservation) Amendment Act, 2023. They feared that a narrower legal meaning of &#8220;forest&#8221; would make diversion easier. Such a meaning might leave out categories like &#8220;deemed forests&#8221;. Critics also feared that gram sabha consent, so important in Scheduled Areas, might weaken in practice. In simple words, they feared that officials would treat forests as paperwork and not as community habitats.<\/p>\n<p>The picture needs a date stamp. The 2023 amendment renamed the 1980 Act as the Van (Sanrakshan Evam Samvardhan) Adhiniyam. Critics argue that it narrows which lands count as forest, while the government says it supports conservation and national projects. On 19 February 2024 the Supreme Court gave an interim order in the challenge to the amendment. It directed states and Union Territories to follow the broader 1996 Godavarman meaning of &#8220;forest&#8221; until forest land is identified under the 2023 rules. The later course of that challenge is not verified here. Do not claim that anyone has formally removed gram sabha consent. The concern here is that it may weaken in practice.<\/p>\n<h2>What the Dongria Kondh are demanding<\/h2>\n<p>Local collectives such as the Niyamgiri Suraksha Samiti ask for something simple: recognise forest rights first, as the law promises. They demand immediate recognition of Community Forest Rights and Individual Forest Rights under the Forest Rights Act, 2006.<\/p>\n<h2>The anthropological lens: more than land<\/h2>\n<p>In anthropology, development-induced displacement is more than relocation from one place to another. It includes the loss of sacred geography and cultural meaning, the breakdown of traditional institutions and community authority, and stress on social life, nutrition and health from ecological disruption. That is why such movements often look emotional from outside. In fact they are rational fights for cultural survival.<\/p>\n<h2>Using it in UPSC Mains<\/h2>\n<p>Paper 2, clause 6.3 covers developmental projects and their impact on tribal displacement and problems of rehabilitation, together with the development of forest policy and tribals. Niyamgiri is the standard Indian case where a sacred landscape, a mining project and the Forest Rights Act collide. So it answers both halves of the clause.
